Abstract:
актуальность темы обусловлена активным внедрением информационно-телекоммуникационных технологий в отечественное уголовное судопроизводство, необходимостью пересмотра традиционных способов получения доказательств, применения современных технических средств, обеспечивающих удаленное получение и исследование имеющей значение для уголовного дела информации. Цель статьи заключается в разработке теоретических положений и практических рекомендаций по проведению проверки показаний опосредованно, с использованием онлайн-трансляции. Методологию исследования составили диалектический метод, комплекс общенаучных и специальных методов научного познания (анализ, синтез, моделирование, сравнительно-правовой), в том числе и системный подход. Обозначены и рассмотрены предпосылки, организационные, технические и тактические вопросы проверки показаний в судебном следствии. Высказаны предложения относительно изменения уголовно-процессуального законодательства, позволяющие легализовать процедуру рассматриваемого способа получения ... : the relevance of the topic is due to the active introduction of information and telecommunication technologies in domestic criminal proceedings, the need to revise traditional methods of obtaining evidence, the use of modern technical means that provide remote receipt and research of information relevant to the criminal case. The purpose of the article is to develop theoretical provisions and practical recommendations for the verification of indications indirectly, using an online broadcast. The methodology of the study consisted of the dialectical method, a complex of general scientific and special methods of scientific cognition (analysis, synthesis, modeling, comparative law), including a systematic approach. The prerequisites, organizational, technical and tactical issues of verification of testimony in the judicial investigation are identified and considered. Suggestions were made regarding changes in the criminal procedure legislation, allowing to legalize the procedure. ...
