Limites no emprego dos sistemas aéreos autónomos à luz do direito internacional humanitário
Abstract: Motivado pelo desenvolvimento de Sistemas Aéreos Autónomos (SAA), surge a dialética entre o emprego destes sistemas dotados com inteligência artificial (IA) e a problemática da aplicação do Direito Internacional Humanitário (DIH) à máquinas com capacidade de decisão própria, pelo que se torna necessário conhecer qual a interpretação do Direito Internacional (DI) no que se refere ao emprego de SAA e se este posicionamento pode limitar a sua capacidade de uso e se é necessário um novo regime jurídico. Através de uma metodologia assente numa estratégia científica de investigação qualitativa, segundo um raciocínio indutivo, abordou-se a utilização dos Sistemas Aéreos Autónomos em conflitos armados pelas Forças Armadas (FFAA), com o objetivo de compreender a forma como, mediante a aplicação do DIH, as operações militares com estes sistemas aéreos são afetadas. O estudo permitiu concluir que os Sistemas Aéreos Autónomos não são considerados pelo Direito Internacional ilegais per se como sistemas de armas, mas as suas capacidades são afetadas e limitadas pela proteção conferida pelo Direito Internacional Humanitário, especialmente quando falamos de Sistemas Aéreos Autónomos Letais (SAAL), para os quais considera-se que sempre tem de haver um controlo humano significativo. ; Motivated by the development of Autonomous Aircraft Systems, arise a dialectic between the use of these systems equipped with artificial intelligence and the problem of applying International Humanitarian Law to machines with their own decision-making capacity, , which makes it necessary to know the position in relation to the interpretation of International Law regarding the use of Autonomous Aircraft Systems, and whether this position may limit the capacity of its use, and finally if a new legal regime is needed. Using a methodology based on a qualitative scientific research strategy within an inductive reasoning, the use of Autonomous Aircraft Systems in armed conflicts by Armed Forces was addressed to understand how, through the application of International Law, military operations involving these air systems are affected. The study concluded that Autonomous Aircraft Systems under international law are not illegal “per se” as weapons systems, but their capacities are affected and limited by the protection afforded by International Humanitarian Law, especially when talking about Lethal Autonomous Aircraft Systems, considering that there must always be a Meaningful Human Control.
