Abstract:
Світові тенденції та глобальні перетворення, що викликані вимогами сучасного життя, переплетінням економічних, соціальних, політичних і багатьох інших чинників, зумовили поступову інтеграцію європейських країн, становлення всесвітнього інформаційного поля, зростаючу взаємозалежність «національних» економік. Ґенеза прав національних меншин – це закрите для широкого загалу питання, історичний шлях, який пройшли національні меншини у напрямку встановлення сучасної системи захисту прав людини та побудови нового міжнародного порядку, що має не тільки теоретичне, але й практичне значення.Разом з цим, є спроби опору процесам інтернаціоналізації, автаркія, рецидиви імперського мислення, націоналізм і зростаюча нетерпимість щодо представників меншості. Нерідко і на побутовому рівні, і в офіційній політико-правовій доктрині спрацьовує хибна формула етноцентризму, відповідно до якої для вирішення будь-яких проблем начебто достатньо «закрити кордони» або «самовизначитися», однак життя спростовує ці ілюзії, що підтверджується висновками статті.Не випадково, що до теперішнього часу юридичною наукою не вироблено загальновизнаного поняття «національна меншина», а нерідко і в офіційних документах, і в наукових працях національні меншості не відмежовуються як від інших соціальних груп (мовних, релігійних, расових та інших), так і від більш широкої категорії «меншість». Очевидно, що проблема наукового визначення цього поняття детермінована складністю та багатоаспектністю проблем розбудови демократичної правової держави ; Мировые тенденции и глобальные преобразования, вызванные требованиями современной жизни, переплетением экономических, социальных, политических и многих других факторов, обусловили их постепенную интеграцию европейских стран, становление всемирного информационного поля, растущую взаимозависимость «национальных» экономик. Генезис прав национальных меньшинств - это закрытий для общественности вопрос, исторический путь, который прошли национальные меньшинства в направлении установления современной системы защиты прав человека и построения нового международного порядка, имеет не только теоретическое, но и практическое значение.Вместе с тем, есть попытки сопротивления процессам интернационализации, автаркия, рецидивы имперского мышления, национализм и растущая нетерпимость в отношении представителей меньшинства. Нередко и на бытовом уровне, и в официальной политико-правовой доктрине срабатывает ложная формула этноцентризма, согласно которой для решения любых проблем вроде достаточно «закрыть границы» или «самоопределиться», однако жизнь опровергает эти иллюзии, что подтверждается выводами статьи.Не случайно, что до настоящего времени юридической наукой не выработано общепризнанного понятия «национальное меньшинство», а нередко и в официальных документах, и в научных трудах национальные меньшинства не отмежевываются как от других социальных групп (языковых, религиозных, расовых и других), так и от более широкой категории «меньшинство». Очевидно, что проблема научного определения этого понятия детерминирована сложностью и многоаспектностью проблем развития демократического правового государства ; Global trends and global transformations, caused by the demands of modern life, the intertwining of economic, social, political and many other factors, have led to the gradual integration of European countries, the formation of a global information field, the growing interdependence of "national" economies. The genesis of the rights of national minorities is a closed issue for the general public, a historical path, taken by national minorities in the direction of establishing a modern system of human rights protection and building a new international order that has not only theoretical, but also practical significance.At the same time, there are attempts to resist the processes of internationalization, autarky, recurrences of imperial thinking, nationalism and growing intolerance of members of the minority. Often, both at the household level and in the official political and legal doctrine, the wrong formula of ethnocentrism works, according to which it seems enough to "close borders" or "self-determine" to solve any problem, but life refutes these illusions, which is confirmed by the conclusions of the article.It is no coincidence, that legal science has not yet developed a generally accepted concept of "national minority", and often in official documents and scientific works, national minorities are not separated from other social groups (linguistic, religious, racial and others) and from the broader category of "minority". It is obvious, that the problem of scientific definition of this concept is determined by the complexity and multifaceted problems of building a democratic state, governed by the rule of law
