Adjectival vagueness in Legal Language

Abstract:
Die vorliegende Studie zielt darauf ab, die Beziehung zwischen sprachlicher Vagheit und Rechtsauslegung zu erforschen, wobei davon ausgegangen wird, dass die Herrschaft des Rechts eine Herrschaft der Sprache ist. Auf Basis etablierter Konzepte der Pragmatik wird im einführenden Teil dieser Arbeit die hohe Relevanz des Midasprinzips nach Kelsen dargelegt und auf die Tatsache hingewiesen, dass Normeninterpretation ohne die Sprache schlichtweg unmöglich ist. Die konzeptuellen Unterschiede zwischen Ambiguität, Unbestimmtheit und Vagheit werden weiters unter Bezugnahme auf zeitgenössische rechtstheoretische Positionen kritisch diskutiert. Die Arbeit führt auch die theoretische Unterscheidung in Nomeme (abstrakte normative Einheiten sozialer Präskription) und Normen (explizite sprachliche Realisierungen abstrakter nicht-sprachlicher Konstrukte) ein. Nach einer allgemeinen Diskussion zur Sprachinterpretation werden die verschiedenen Methoden der Rechtsauslegung im österreichischen Privatrecht erläutert und die Bedeutung von Adjektiven hinsichtlich ihres Vagheitspotentials und ihrer Präzisierungsbedürftigkeit dargestellt. Anschließend wird eine kurze Einführung zum Allgemeinen Bürgerlichen Gesetzbuch gegeben, in welcher der grundlegende juristische und rechtsgeschichtliche Kontext und die zeitgenössische Bedeutung und Struktur der Kodifikation dargestellt wird. Der empirische Teil der vorliegenden Arbeit besteht aus einer quantitativen und qualitativen Analyse der Adjektive in der Übersetzung des Allgemeinen Bürgerlichen Gesetzbuches in der Fassung von 2013. Im replikativen Teil wird der Versuch unternommen, die quantitative Verteilung aller nachgewiesenen Adjektive im ABGB darzustellen und nach Pinkals Klassifikation einzuteilen. Im qualitativen Teil der Arbeit wird eine Auswahl der relevantesten Beispiele im Hinblick auf das Kontinuum zwischen Präzisierung und Depräzisierung näher untersucht. Es ist anzunehmen, dass relative Adjektive häufiger in normativen Texten vorkommen als bisher von der Forschung angenommen und dass evaluative Adjektive in der Tat zu extremen Fällen sprachlicher Unbestimmtheit führen können. Abschließend wird festgestellt, dass aus der Perspektive der Angewandten Linguistik der Wert der Vagheit möglicherweise in der Anwendbarkeit von sprachlicher Unbestimmtheit im rechtswissenschaftlichen Studium wie auch im Bereich der Rechtsaptitätsforschung liegen könnte. ; Based on the assumption that the rule of law is the rule of language, this study seeks to investigate the relationship between linguistic vagueness and legal interpretation. Drawing on established concepts in pragmatics, it is argued in the introductory section that the Midas touch of the law is highly relevant for research in applied linguistics for several reasons, the most crucial being that there is no legal meaning-making without language. The conceptual differences between ambiguity, indefiniteness, indeterminacy and vagueness are discussed and related to contemporary legal theory. A theoretical distinction is made between nomemes (abstract units of social prescription) and norms (explicit linguistic realisations of abstract non-linguistic constructs). After a general discussion of language interpretation in general and the various meaning-seeking methods under Austrian civil law specifically, the role of adjectives as contributors to vagueness and their precisification qualities are discussed. A short introduction to the Austrian Civil Code is provided, presenting its legal context and history, the contemporary significance of the work and its overall structure. The empirical part of this thesis consists of a quantitative and qualitative analysis of the adjectives found in the English translation of the codification as published in 2013. In the replicative part of the project, the quantitative distribution of all attested adjectives in the ABGB is presented and classified according to Pinkal’s taxonomy. A selection of the most relevant linguistic samples is analysed with regard to the space between precisification and deprecisification. It is suggested that relative adjectives may occur more frequently in normative texts than has previously been assumed, with evaluative adjectives leading to extreme cases of linguistic indeterminacy. The conclusion is drawn that an applied linguistics perspective on the value of vagueness may focus on the applicability of linguistic indeterminacy in legal education and legal aptitude testing.
