Reflexão sobre opções linguísticas em Tradução: traduções jurídicas oficiais inglês-português e português-inglês

Abstract:
Esta dissertação tem como principal objetivo a análise e reflexão sobre opções linguísticas observadas em textos jurídicos recolhidos num corpus bilingue (inglês-português e português-inglês) constituído especificamente para a realização deste trabalho, nomeadamente, questões sintáticas e questões lexicais identificadas em traduções oficiais. Com a finalidade de contribuir para o conhecimento da prática de tradução na área da tradução jurídica de português para inglês e de inglês para português, esta dissertação põe ao serviço da análise as teorias e as estratégias de tradução adquiridas ao longo do primeiro ano de mestrado. No que diz respeito à sua estrutura geral, este trabalho divide-se em três grandes partes. O primeiro capítulo consiste numa breve apresentação do objetivo do trabalho e do corpus recolhido para o realizar. Sendo que os textos constantes do corpus utilizado como ponto de partida para este trabalho correspondem a textos jurídicos originais e as suas respetivas traduções oficiais, a qualidade das traduções consideradas é alta, o que significa que a sistematização de soluções de tradução adotadas constitui uma boa referência e permite identificar exemplos de boas práticas neste domínio. No segundo capítulo é apresentada uma reflexão teórica sobre a Tradução, bem como uma descrição das características principais do texto técnico e da linguagem jurídica. Por fim, no terceiro capítulo faz-se uma análise de fenómenos linguísticos numa perspetiva contrastiva, focando-se em questões sintáticas (distribuição do uso de determinantes possessivos, quantificadores, verbos modais, etc.) e em questões lexicais (tradução de termos e de expressões polissémicas). A identificação de generalizações em termos de opções e de estratégias de tradução utilizadas pelo tradutor de texto jurídico foi igualmente tida em conta. ; This dissertation has as its main object to analyse and reflect on observed linguistic options in legal texts collected in a bilingual corpus (English-Portuguese and Portuguese-English) specifically constituted for this work, namely, syntactic issues and lexical issues identified in official translations. In order to contribute to the knowledge of translation practice in the field of legal translation from Portuguese to English and from English to Portuguese, this dissertation puts at the service of analysis the translation theories and strategies discussed during the first year of the master’s degree in Translation. Regarding its general structure, this work is divided in three main sections. The first chapter consists of a brief presentation of the object of the work and of the corpus collected to carry it out. Since the texts in the corpus used as the starting point for this work correspond to original legal texts and their respective official translations, the quality of the translations considered is high, which means that the systematisation of the adopted translation solutions is a good reference and allows to identify examples of good practices in this field. The second chapter presents a theoretical reflection on Translation, as well as a description of the main characteristics of technical text and legal language. Finally, the third chapter analyses linguistic phenomena in a contrastive perspective, focusing on syntactic issues (distribution of the use of possessive determinants, quantifiers, modal verbs, etc.) and on lexical issues (translation of terms and of polysemic expressions). The identification of generalisations in terms of translation options and strategies used by translators of legal text was also considered.
