Linguistic Minorities and the Right to Languages (Minorías lingüísticas y derecho a las lenguas)

Abstract: Resumen: Esta contribución se centra en la noción de minorías lingüísticas y en el derecho a las lenguas desde una perspectiva sociopolítica y cultural. Se ofrece una definición de lo que se considera “minoría lingüística” con ejemplos representativos de lenguas bajo esta consideración así como datos que ratifican la existencia, vitalidad y extinción de éstas según el contexto moderno de la globalización. Además se incluyen situaciones de multilingüismo y diglosia y cómo el estado ha respondido constitucionalmente a las necesidades de estas comunidades, incluyendo programas educativos, legislaciones internas y derecho de lenguas. Para ello se han escogido una selección de países en Europa y América que se destacan por su perfil lingüístico en sus estatutos educativo y legislativo. Se propone un marco de reflexión a la realidad sociolingüística entre lenguas minoritarias y lenguas oficiales que esclarezca la complejidad de las disposiciones básicas jurídicas y los modelos de gestión. Del mismo modo se pretende iniciar un diálogo con el lector para resaltar que el derecho a la lengua se constituye como una necesidad pública a favor del respeto a los derechos humanos. Abstract: This paper focuses on the notion of linguistic minorities and on the right to a language from a sociopolitical and cultural perspective. The concept of “linguistic minority” is studied with representative examples of languages under this category and with relevant data to classify a language as minority in terms of officiality, vitality, and extinction in the modern context of globalization. Multilingualism and diglossia are also considered under the scope of minority languages, altogether with governments’ responses to minority communities according to their educative programs, language law and language rights. A few countries from Europa and America have been selected as a prototype of study due to their linguistic profiles in politics and education. The main purpose of this article is to offer an insight and an opportunity to reflect on the sociolinguistic reality between minority and official languages and how they are represented in legal policies. At the same time, it intends to open a dialogue with the reader to underline that the right to a language becomes a social need in alliance with human rights.
